Definition

“Made Futures“; “we“; “us“; and “our“; Made in the Midlands Limited (registered number 07538675)  and Yorkshire Forward Limited  (registered number  09625745) trading as Made in Yorkshire  (collectively the “Made Futures”).

“Jobseeker“; “You“ and “Your“ means any person registering with us.

“Recruiter“ means any person, company, organisation or firm which advertises job vacancies on Made Futures site to assist their recruitment needs and is granted access to search jobseeker profiles on our website.

“Events” means any conference, trade show, exhibition, meeting or other gathering (including an online event) hosted by or on behalf of, Made Futures.

“Social Media” means the channels, sites and postings made by Made Futures on any social media sites including without limitation, Facebook, Twitter, Instagram, LinkedIn third parties’ web sites and YouTube and What’s App.

“Website” means the Made Futures www.madefutures.com website.

The Basis of Access to Services

2.1  Made Futures will permit the Jobseeker to access, use and interact with our website subject to these terms and conditions.

2.2  Made Futures shall have the right to vary the terms from time to time. Such changes shall either be notified to you by e-mail or posted on the Website. Changes in this manner shall be deemed to have been accepted if you continue to use the Website and/or the Services after a period of 14 days from the date of transmission of the e-mail or newsletter, or of posting on the Website, whichever occurs later.

2.3  Access to the website is provided solely to the Jobseekers. Made Futures may terminate, suspend or deny you access to the Website and/or Services immediately for any reason without incurring any liability whatsoever.

Jobseeker agrees to;

3.1  Provide information suitable for use with the Website, including without limitation, the address, contact details , CV, Covering Letter and to share them with Recruiters.

3.2  To comply with any Made Futures Code of the Conduct including in the posting of information on the Website and Social Media and not include any content that is untrue, defamatory, unlawful or which has as its object the harassment or lowering of the reputation of any entity, group or person.

3.3  To deal politely with the staff and representatives of Made Futures, together with Recruiters and to refrain from using verbal abuse, aggressive, inappropriate or threatening behaviour.

Warranties

4.1  Made Futures does not warrant that the use of, and access to, the Website and Social Media will be uninterrupted or error-free and specifically does not warrant the Website  and Social Media will be provided in case of lack of internet connectivity as a result of a fault by the data host, the Jobseeker, the Recruiter or any third party.

4.2  Made Futures does not provide any warranties in relation to the Events, including the size of the Event, the occurrence, the timing, the content and duration of the programme, the speakers and the number Recruiters or delegates attending the Event.

4.3  Made Futures shall have the right to cancel the Event or to limit numbers to the Event according to the size of the venue and shall have the right to refuse access in any event.

4.4  There is no warranty in relation to the Website, Social Media, the Services, including the Events, if any part of the problem or failure results from a third party, for any reason outside Made Futures control. This includes any security breaches, cyber-attack or other third party spam attacks using information gained from the Website.

Exemptions and Limitations of Liability

5.1  Whilst Made Futures may accept liability for death or personal injury directly and solely caused by its act or omission, it will not be liable for any loss or damage howsoever caused (even if foreseeable) in connection with the use of its services, including any loss or damage caused by third parties, suppliers, Jobseekers, Recruiters, Social Media hosts, users or delegates to events.

5.2 Made Futures will not be liable to Jobseekers for:

5.2.1 Any loss of profits or prospects; or

5.2.2  Any loss of data or failure to comply with Data Protection Legislation

5.2.3  Any loss of future earnings; or

5.2.4  Depletion of any goodwill and/or similar losses; or

5.2.5  Any loss of revenue; or

5.2.6  Any wasted costs or expenses; or

5.2.7  Any loss of anticipated savings; or

5.2.8  Any loss of goods or services; or

5.2.9 Any loss of contract; or

5.2.10  Any loss of reputation; or

5.2.11 Any loss caused by Made Futures their employees or agents, as a result of the actions or instructions of any Recruiter or Jobseeker;

5.3 Made Futures will not be liable for any special, indirect, consequential or pure economic or financial loss, costs, damages, charges or expenses.

5.4  Where Made Futures has introduced the Jobseeker, gives no warranty or guarantee as to the suitability of vacancies offered by Recruiters or third parties.

5.5. Where Made Futures has introduced Jobseeker, Made Futures gives no warranty or guarantee as to the creditworthiness or standing of the Recruiter or third party.

General

6.1 Made Futures may assign, transfer, sub-contract, or in any other manner make over to any third party the benefit and/or burden of this Contract.

6.2 Made Futures may update the versions of Terms and Conditions from time to time without the consent of Jobseekers  by making the latest version available on the Website or shared via email,or newsletter. Any change or exception to the terms  requested by Jobseeker requires the written consent of Made Futures.

6.3 Any notices to be delivered in writing and delivered by pre-paid first class post to or left by hand delivery at the registered address or place of business of the notified party, or sent by email using [email protected],  to an authorised representative. Notices sent by post shall be deemed to be delivered on the second business day after posting; notices delivered by hand will be deemed to have been received at the time the notice is left at the proper address; Notices sent by email will be deemed to have been received on the next business day after transmission (although there may be a delay in acknowledgment). Oral notices shall not be valid.

Whole Agreement

7.1 This Agreement contains the whole agreement between the parties relating to the transactions contemplated by the Agreement and supersedes all previous versions of this agreement between the parties relating to these transactions.

7.2  Nothing in this clause shall prejudice either party’s right to a cause of action in fraudulent misrepresentation.
